Pre-Construction Regulatory Requirements

Works may commence on site 30 days after the approved permit is published. However, several documents and regulatory submissions must be prepared and approved before starting the work.

Planning Authority Requirements

  • Commencement Notice - This document must be submitted to the Planning Authority at least 5 days before work begins

Building Construction Authority (BCA) Requirements

The following documents must be submitted to the BCA department:
  • Method Statements - Depending on scope, technical method statements must be prepared for each project stage. These may include separate demolition, excavation, and building work documents detailing each phase's specific methodologies, equipment, and safety procedures.
  • Condition Reports - Inspections must be conducted, and detailed technical reports must be prepared to document adjacent properties' condition before construction commences. These reports require coordination with neighbouring property owners and provide baseline documentation for potential future claims.
  • Insurance - A Contractor All Risk (CAR) Insurance is required with minimum €750,000 cover for third parties up to exterior finished state of project in line with LN 38 of 2014. The policy must include confirmation that (a) the works are adequately covered, (b) the value of the excess is clearly stated, and (c) coverage aligns with BCA-approved method statements.
  • Bank Guarantees - Bank guarantees in favour of the BCA are issued in the developer's name per SL 623.06 (regulation 6), equivalent to the maximum excess amount indicated in the insurance policy. Additional guarantees may be required for excavation works. Original documentation must be deposited at BCA offices at The Exchange, Spencer Hill, Marsa, MRS 1982.
  • Full Responsibility Form - This document must be signed by all parties involved in the project.
  • Notice Board - An A2-sized notice board must be placed at the construction site displaying project and permit information.

Required Professional Appointments

  • Site Technical Officer (STO) - The contractor must engage an STO for all construction phases (demolition, excavation, and construction). The STO must be a warranted Perit, Engineer, or qualified professional listed in the STO register maintained by the BCA.
  • Health and Safety Officer - Each site requires a designated health and safety officer to ensure compliance with Occupational Health and Safety Authority (OHSA) guidelines.

This appointment is legally required for construction projects in Malta to minimize workplace hazards and ensure regulatory compliance.
